PCApproval (the Service) is a mortgage information, rates, news, and software service provided by PCLender.com (PCL). As a condition of your use of the Service we require you to expressly be aware that our Database and Software were compiled, prepared, revised, selected and arranged by PCL and/or its third-party suppliers through the application of methods and standards of judgment developed and applied through the expenditure of substantial time, effort and money. The Database and Software constitute valuable intellectual property and contain trade secrets of PCL and/or its third-party suppliers. You specifically agree as a pre-condition to accessing and using the Service to protect the copyrights and all other proprietary rights of PCL and its suppliers in the Database and Software. You further agree not to alter the presentation, reproduce, retransmit, disseminate, sell, distribute, publish, broadcast, circulate or commercially exploit the information in any manner without the express written consent of PCL. You also agree to not use the Information for any unlawful purpose. The Service includes facts, views, opinions and recommendations of individuals and organizations deemed of interest to our users. PCL does not guarantee the accuracy, completeness or timeliness of, or otherwise endorse these facts, views, opinions or recommendations.

PAYMENT

Payments are due monthly and shall be calculated based on the utilization option selected by the client. PCApproval will bill every 30 days for service provided for the previous period. Payment for services rendered is expected 30 days after invoice date. Should payment not be received within 90 days PCApproval has the right to unconditionally terminate service offered. Any termination by PCApproval or the Customer shall not relieve the customer of any obligations to pay fees accrued prior to such termination. PCApproval and its management reserve the right to terminate an account and any implied rights to access PCApproval services at the sole discretion of PCApproval or its management.

BORROWER INFORMATION

When a potential borrower registers, or otherwise give us personal information, PCApproval will not share that information with any other third parties without your and/or the potential borrowers permission, other than for the limited exceptions already listed. It will only be used for the purposes stated below.

We may use borrower information for any lawful purpose. We may merge site-visitation data with anonymous demographic information for research purposes, and we may use this information in aggregate to provide more relevant content. In some limited-entry sections of PCApproval.com, with borrowers approval, we will combine site-visitation data with their personal information in order to provide borrowers with personalized content. If they decline permission, we will not provide them the personalized service and won't merge their personal information with site-visitation data.

We occasionally hire other companies to provide limited services on our behalf, including packaging, mailing and delivering purchases, answering customer questions about products or services, sending postal mail and processing event registration. We will only provide those companies the information they need to deliver the service, and they are prohibited from using that information for any other purpose.
PCApproval occasionally allows other companies to offer our registered customers information about their products and services.

PCApproval may send out periodic e-mails informing potential borrowers of technical service or security issues related to a product or service you requested, or confirming you requested a product or service. You will not be able to choose to unsubscribe to these mailings, as they are considered an essential part of the service you have chosen.

DISCLAIMER OF WARRANTIES AND LIABILITY

PCL AND ITS THIRD-PARTY SUPPLIERS MAKE NO WARRANTS THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.. PCL MAKES NO EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS OF THE SERVICE FOR A PARTICULAR PURPOSE OR USE. The information contained in the

Database has been obtained from sources considered by PCL to be reliable. However, the accuracy and completeness thereof are not guaranteed and PCL and its third-party suppliers shall have no liability for errors or omissions with respect to the service or its delivery, regardless of the cause or source of such error or omission.

NEITHER PCL OR ANY OF ITS THIRD-PARTY SUPPLIERS SHALL HAVE ANY LIABILITY TO A USER OR TO OTHERS FOR ANY LOST PROFITS OR INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.

PCL and its third party suppliers shall not be liable to the User for any delay or default in providing the Service resulting from any circumstances beyond its reasonable control.

PCL may change or discontinue the Service, or its availability to you, at any time without notice. If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.
